1. Overview

These Terms govern your use of cartaclara.com and our online menu management, table bookings, and AI-based receptionist features (“Services”). By using the Services, you agree to these Terms.

2. Eligibility & Accounts

You are at least 18 and have authority to bind your organization. Keep your account credentials secure.

3. Use of Services

Use the Services only in compliance with law and these Terms. Do not reverse engineer, disrupt, or misuse the Services. You are responsible for the accuracy of your menu content, availability, and communications with your customers.

4. Fees and Payments

Fees (if any) are shown at checkout or in your order. Payments are processed by our provider. Taxes may apply.

5. Cancellations and Refunds

See our Refunds & Cancellations Policy at cartaclara.com/documents/refunds. You can cancel renewals anytime before the next billing cycle.

6. Communications

We may send transactional emails. Marketing and WhatsApp messages require your consent and include opt‑out options. Voice features may be available via third‑party telephony providers and must be used in compliance with applicable law.

7. Customer Content & License

You own your content (e.g., menus, images, branding). You grant us a limited license to host, display, and process your content and customer interactions as needed to operate the Services.

8. Bookings & AI Features

You are responsible for honoring bookings accepted via the Services and for configuring your AI receptionist. AI features may generate outputs that are not error‑free; you should review critical communications.

9. Acceptable Use

No illegal, infringing, harmful, or abusive activities. Do not use the Services to collect highly sensitive data (e.g., full payment card numbers, government IDs) via chat/voice.

10. Third‑Party Services

Some features rely on third‑party services (e.g., hosting, analytics, payments, WhatsApp/telephony). Their terms and privacy policies apply in addition to ours.

11. Disclaimers

Services are provided “as is” and “as available.”

12. Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect or consequential damages. Our total liability will not exceed the amounts you paid in the 12 months before the claim.

13. Indemnification

You will indemnify us for claims arising from your use of the Services or your content.

14. Governing Law; Venue

Delaware law governs these Terms. Courts located in Delaware shall have exclusive jurisdiction, unless prohibited by law.

15. Changes

We may update these Terms; continued use means acceptance.
